Guidance from the U.S. State Department on the treatment of Dual and Third Country Nationals in relation to FMS acquired technology

This guidance relates to how Dual and Third Country nationals may handle FMS articles, which are controlled by the Arms Export Control Act (and not the ITAR). Recent U.S. and Australia Export Control Reforms

U.S. Export Control Reform directly affect Australian companies trading articles and technology that are controlled by the International Traffic in Arms Regulations (ITAR) or the U.S.’ Export Administration Regulations (EAR). While the reforms are designed to ultimately make trade easier, the move of thousands of previously ITAR controlled articles to the EAR’s Commerce Control List (CCL) will present a large learning curve for Australian companies that are not accustomed to working with the EAR. Australian legislation has also evolved to include controls on intangible exports (DSGL listed goods that are exported via email, video conference, or other intangible means) and permits for such exports must now be obtained from Defence Export Controls prior to making such an intangible supply.
